Software License and Usage Terms

Maxem retains all intellectual property rights to its Services and the Maxem Energy Controller, including, but not limited to, all firmware or software embedded in the equipment (the "Maxem Energy Controller") or used to provide the Services (the "Software").
Maxem grants you a non-exclusive, non-transferable license to use the Software solely in object code form (without making any modifications) (the "License"), solely in connection with your use of the Maxem Energy Controller and the Services, and subject to the terms and restrictions of this License.
You shall not take any action, or permit any third party to take any action, to decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code from the binary code of the Software.
Certain portions of the Software (the "Open Source Components") may be subject to so-called "open source" software licenses, meaning software licenses approved by the Open Source Initiative or substantially similar licenses.
To the extent required by the license terms applicable to third-party Open Source Components, those Open Source Components shall be governed by the terms of the applicable open source license rather than the terms of this License.
To the extent that any restriction in this License concerning a third-party Open Source Component is prohibited by the terms of the applicable open source license, that restriction shall not apply to the relevant Open Source Component.
To the extent that the license terms applicable to third-party Open Source Components require Maxem to provide access to the source code or related information for those Open Source Components, such access is hereby provided. You may request access to the source code of our Open Source Components through your Maxem support account.
