Software License and Usage Terms
Maxem retains all intellectual property rights to their Services and Maxem Energy Controller, including but not limited to all firmware or software embedded in the equipment ('Maxem Energy Controller') or used to provide the Services ('Software'). Maxem grants you a non-exclusive, non-transferable license to use the Software solely in the form of object code (without making any modifications) ('License'), solely in connection with the use of the Maxem Energy Controller in relation to the Services and subject to the terms and restrictions of this License. You shall not take any action or allow anyone else to take action that aims to decompile, disassemble, or reverse-engineer the Software, or any other attempts to derive the source code from the binary code of the Software.
Certain parts of such Software ('Open Source components') may be subject to so-called 'open source' software licenses, i.e., software licenses approved by the Open Source Initiative as open source licenses or substantially similar licenses. To the extent required by the licenses for third-party Open Source components, such Open Source components will be subject to the terms of such licenses instead of the terms of this License. To the extent that a limitation in this License regarding a third-party Open Source component is prohibited by the terms of a license applicable to that Open Source component, that limitation will not apply to that Open Source component. To the extent the terms of a license applicable to third-party Open Source components require Maxem to provide access to the source code or related information regarding the Open Source components, such access is hereby provided. You can request access to the code of our Open Source components through your Maxem support account.
